How many claims are made against the NHS every year?
According to the latest NHS Resolution Annual Report & Accounts, the NHS received 14,428 claims requests nationwide in the 2024/2025 financial year. For perspective, this is equivalent to nearly 40 claims received per day.
This is a 4.7% increase from 2023/2024’s figures, and marks the latest in a longer trend of medical negligence claims growing since 2006/2007.

However, while this number appears large, it pales in comparison to the estimated 353 million primary care appointments with local GP practices in 2023/2024. This reassures us that incidents of medical negligence remain a rarity, albeit one that has consistently grown in the last two decades.
How does national claims data compare to Essex claims data?
To compare medical negligence claims data in Essex with national figures, we have compiled the data from four Essex-based NHS Trusts:
- Mid and South Essex NHS Foundation Trust
- Essex Partnership University NHS Foundation Trust
- East Suffolk and North Essex NHS Foundation Trust
- The Princess Alexandra Hospital NHS Trust
According to this data, these Essex-based trusts accounted for 424 claims received in 2024/2025 – approximately 3% of the total claims nationwide across 134 NHS Trusts.

This represented a 5.7% rise in the number of claims compared to 2023/2024 figures, and a 22.9% increase on 2022/2023. Consequently, we can see that the growth rate of clinical claims in Essex is slightly greater than the national rate, but not by enough to suggest that Essex NHS Trusts are more prone to errors.
Our own experience as solicitors in Essex tells a slightly different story. In 2024, we received 979 claims requests from prospective claimants – a 17% growth on 2023’s figures. Our number of accepted cases saw a similar increase.

Fundamentally, both NHS Resolution data and our local data in Essex demonstrate that more medical negligence claims are being made every year. This puts more emphasis on choosing a specialist law firm to represent your case.

What is the most common type of medical negligence claim?
In NHS Resolution’s 2024/2025 report, emergency medicine was the specialty that attracted the largest percentage of medical negligence claims (13.1%), followed by orthopaedic surgery (11.5%) and obstetrics (11.2%).

These were the same top three types of medical negligence claims in NHS Resolution’s 2023/2024 report, also. However, emergency medicine and obstetrics dropped from 13.3% and 12.8% respectively, while orthopaedic surgery rose from 10.8%.
This is especially notable for obstetrics, also known as birth injuries, with data suggesting a decline in the proportion of these claims compared to other specialties.
What is the most common type of medical negligence claim in Essex? (H3)
At Gadsby Wicks, we categorise our claims differently from NHS Resolution. In our local medical negligence experience in Essex, delayed diagnosis or treatment is consistently the most common type of claim we manage.

We have also noticed trends in the flow of claims enquiries:
- Birth injury claim enquiries are trending downwards (10% in 2022 to 3% in 2025)
- Surgical injury claims are steadily increasing (14% in 2022 to 21% in 2025)
- Delayed treatment claims and inadequate treatment claims remain consistent year-on-year

How much compensation does the NHS payout every year?
NHS Resolution states that a total of £3.09 billion was paid against all NHS clinical negligence schemes in 2024/2025, with £2.29 billion representing compensation paid to the claimants.
This was a near 10% rise over 2023/2024 figures. However, this also takes into account that there was an 8% increase in the number of clinical claims closed with damages awarded. Nonetheless, it suggests that there has been a slight increase in the overall value of claims, and a greater proportion of high-value claims.

Looking more closely, obstetrics (birth injury) claims are the most “valuable” type of claim, accounting for a substantial 52.5% of the value of claims received in 2024/2025. For comparison, the next largest specialty, emergency medicine, represented just 7.1%.

The national data aligns closely with our medical negligence claims data in Essex, where over the past five years our estimated case value has totalled £107,983,000.
Although birth injury claims have accounted for just 6% of all claims we have managed since 2021, they represent over 44% of the estimated case value in this period.

This is not hugely surprising. In our 30 years of exclusive experience in medical negligence, birth injury claims are typically the most complex cases, and claimants will usually require lifelong care and treatment, such as claims involving Cerebral Palsy.
However, our local data demonstrate a more diverse spread of compensation awarded than NHS Resolution’s national statistics, with delayed diagnosis or treatment representing 27% of our estimated case value between 2021 and 2025.
The main takeaway from this is that the total cost of clinical negligence is on the rise alongside the number of claims, and that cases with the most significant, long-term repercussions (such as birth injury claims) typically attract the largest amounts of compensation.
Birth injury, obstetrics and maternity claim statistics
In recent years, numerous reports have circulated about the poor state of maternity care in the NHS. This includes a recent analysis of NHS figures that claims the cost of maternity negligence in England since 2019 totals £27.4 billion.
1,286 families launched claims against the NHS for obstetrics errors (birth injuries) in 2024/2025 – nearly double the 677 claims made in 2007/2008.

However, closer analysis reveals that this is a near 8% decrease in the number of birth injury claims in 2023/2024. Plus, although the £27.4 billion estimate since 2019 is accurate, in the past three years (2022/2023 - 2024/2025), the cost of harm is around £8.4 billion – less than a third of the six-year total.

What does this mean? They may be indications that NHS maternity care is showing signs of improvement nationwide, or that the “average” cost of birth injury claims has declined in recent years.
Birth injury claims in Essex statistics
In the Essex area specifically, NHS Resolution data reveals that two Essex-based Trusts – Mid and South Essex NHS Foundation Trust and East Suffolk and North Essex NHS Foundation Trust – accounted for 267 birth injury claims between 2018/2019 and 2023/2024.
In fact, Mid and South Essex NHS Foundation Trust received the second-most birth injury claims of any NHS Trust in this time period (only behind Manchester University NHS Foundation Trust), and paid the most damages of any Trust for birth injuries in this same period (£105.4 million across 123 claims).

This data illustrates that birth injuries have been more common in Essex-based Trusts than in other areas over the past six years. However, our own data at Gadsby Wicks indicates improvements in the most recent years.
Since a peak number of birth injury claim enquiries in 2022, with have witnessed year-on-year declines:
- A 13% decrease in 2023
- A 49% decrease in 2024
- A 27% decrease in 2025
Although a small sample size, our data may suggest that maternity care in the Essex area is showing signs of improvement, resulting in fewer birth injury enquiries, which is unquestionably good news.

In 2024/2025, NHS Resolution reported that 83% of medical negligence claims settle outside of court – a number that has been consistently rising since 2016/2017.

This trend is excellent news as it means fewer claimants are required to endure the stress of going to court to receive a settlement. It also means that less money is dedicated to costly court proceedings, which is crucial in the ongoing battle to reduce the cost of medical negligence.
