Specialist Medical Negligence Solicitors

What is medical negligence?

Medical negligence is sometimes known as clinical negligence and occurs when a medical professional fails to provide treatment to the appropriate standard.  If this error or omission results in you being injured, you will be entitled to compensation.

It does not matter if you have been treated under the NHS or privately, or by a GP or specialist.

Who to claim against?

Claims can be made against:-

  • GPs
  • Hospital doctors
  • Nurses/midwives
  • Dentists
  • Physiotherapists/osteopaths
  • Psychologists/psychiatrists
  • Opticians
  • NHS and private hospitals
  • Private clinics
  • Private doctors

If the negligent treatment occurred in an NHS hospital, then the negligence claim will be made against the relevant NHS Hospital Trust, not an individual doctor or nurse. If a GP was responsible, or your treatment was in a private hospital, then the claim will be made against the individual doctor.

Most doctors insure against claims for medical and clinical negligence so a successful claim against them will result in their insurance company making a payment of compensation to you.

Can you make a claim?

Following an initial no cost, no obligation discussion with one of our nurses, we will be able to tell you if we can take on your claim.  If so, one of our lawyers will carry out a thorough investigation into what happened and, working closely with independent medical experts, build the strongest possible case for you.

Following our investigation we will be able to tell you if you have a valid claim and against whom the claim should be made. The National Health Service Litigation Authority handles all medical and clinical negligence claims against NHS hospitals but there are different procedures for general practitioners and doctors working in private hospitals. Whoever your claim is against, we will guide you through the legal process.

The amount of compensation

The amount of your compensation for medical or clinical negligence will depend upon the pain and suffering you have experienced, the effect of the negligent treatment on your ability to continue your previous lifestyle with regard to work, hobbies etc. and your actual and anticipated financial losses. Whilst financial compensation might not be at the top of your list of objectives for pursuing a claim, it is the remedy that is used to compensate you for your suffering.
